Welcome to Arham Investment. These Terms & Conditions constitute a legally binding agreement between you (the "User", "Client", or "Trader") and Arham Investment ("Company", "we", "us", or "our"). By purchasing, downloading, accessing, or utilizing our proprietary TradingView indicators, Pine Script scripts, algorithmic execution software, trade validation tools, or educational courses, you explicitly accept and agree to be bound by these terms.
Mandatory Regulatory & Financial Risk Notice
Trading financial instruments including equities, derivatives, futures, options, commodities, foreign exchange (Forex), and digital assets involves substantial risk of loss and is not suitable for every investor.
Past performance is not indicative of future results.
All algorithmic systems, indicators, and educational materials provided by Arham Investment are designed for disciplined informational and execution assistance and should not be construed as individualized investment advice.
1Acceptance of Terms & Eligibility
By accessing our platform or subscribing to any software tier, you affirm that:
- You are at least 18 years of age or the age of legal majority in your country of jurisdiction.
- You possess the legal competence and capacity to enter into a binding financial contract.
- You are not barred from accessing financial software or derivatives trading under applicable Indian, CFTC, SEBI, FCA, or international sanctions regimes.
- You accept total responsibility for all trading actions, losses, or margin calls resulting from your market activities.
2Service Description & Scope of Software
Arham Investment provides specialized trading technology, including:
We do not operate as an asset management company, broker-dealer, or portfolio manager. We do not accept customer deposits for proprietary pooled trading.
3Account Registration & Security
When creating an account or providing credentials for script access, you agree to provide accurate, truthful, and up-to-date details. You are responsible for preserving the confidentiality of your account credentials, license keys, and API secrets.
You must immediately notify our support desk if you detect any unauthorized access, suspicious activity, or compromised credentials. Arham Investment will not be liable for losses arising from unauthorized usage of your account.
4Subscription Plans, Payments & Refund Policy
Arham Investment offers products under tiered subscription and lifetime licensing models (e.g., 3 Months, 6 Months, and Lifetime Access). Pricing is denominated in INR and USD.
5License Key Terms & TradingView User Access
Upon purchase, Arham Investment grants you a revocable, non-exclusive, non-transferable, single-user license to access the specified indicators and systems:
- Single-User Restriction: Each license is strictly tethered to one unique TradingView username and one registered client email.
- Prohibition on Sharing: Sharing, renting, leasing, sublicensing, broadcasting signals commercially, or syndicating alerts to unauthorized third parties without explicit enterprise licensing is strictly forbidden.
- Audit & Termination: We reserve the right to monitor concurrent sessions and immediately revoke script access without refund if license sharing or unauthorized redistribution is detected.
6Intellectual Property & Anti-Decompilation
All source algorithms, mathematical formulas, Pine Script logic, visual brand assets, trade validation AI architectures, UI components, and software code are the exclusive proprietary intellectual property of Arham Investment.
You agree that you will not decompile, reverse-engineer, decrypt, extract Pine Script source code, clone indicator visuals, or replicate the proprietary mathematical models for commercial exploitation or competing commercial services. Violators will be subject to civil litigation and statutory copyright damages.
7Comprehensive Risk Disclosure & SEBI / CFTC Notices
Derivatives & High-Leverage Risk: Trading derivatives, futures contracts, options, foreign exchange, commodities, and crypto assets entails high market volatility. Leverage can amplify both profits and losses. You may sustain a total loss of initial margin and incur liability for additional funds.
Execution Latency & Technical Vulnerabilities: Automated order routing, webhooks, and cloud indicators rely on third-party servers, broker APIs, and telecommunication networks. Slippage, requotes, rejected orders, market gaps, and connectivity outages can occur. Arham Investment is not liable for execution latency or broker-side failures.
No Individualized Advice: None of our tools, indicators, backtests, or chatbot outputs represent a recommendation to buy or sell any security. All signals require your independent evaluation and prudent capital allocation.
8Limitation of Liability
To the maximum extent permitted by applicable law, Arham Investment, its founders, developers, and affiliates shall not be liable for any direct, indirect, incidental, punitive, or consequential damages, including without limitation lost trading profits, slippage losses, loss of business opportunity, or hardware damage arising out of the use or inability to use our software.
In all cases, our total aggregate liability for all claims related to the services shall not exceed the total amount actually paid by you to Arham Investment in the three (3) months immediately preceding the event giving rise to liability.
9Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India, without giving effect to conflict of law principles. Any dispute, controversy, or claim arising under or relating to these Terms shall first be addressed through good-faith informal negotiations.
If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the Indian Arbitration and Conciliation Act, with the seat and venue of arbitration held in Bangalore, Karnataka, India.
